MISS ICONIC USACONTESTANT AGREEMENT, RELEASE, AND INDEMNITY AGREEMENT

1 Gender. I am a natural-born female.

2 Marital Status. I am not now, and never have I been married, nor have I had a marriage annulled.

3 Parental Status. I am not now, and never have I been pregnant.

4 Good Character. I am of good moral character, and I have not been involved at any time in any act of moral turpitude.

5 Criminal Record. I have never been convicted of any criminal offense, and there are no criminal charges presently pending against me.

6 Conduct of the Competition. I understand and agree that the Miss Iconic USA Organization shall determine the manner and method of conducting the competition in its sole discretion. I further understand and agree that the Miss Iconic USA Organization shall also determine the time, method, and manner of judging the competition and the awarding and supervision of all scholarships designated in its sole discretion. The decisions of the persons designated by the Miss Iconic USA Organization to judge the various events in all matters pertaining to the selection of the winners shall be final in all respects.

7 Permanent License of Publication Rights. I hereby authorize the Miss Iconic USA National Pageant, and anyone duly licensed or authorized by the Miss Iconic USA Organization, to: (1) televise, photograph, broadcast, and/or make radio, television, video, and audio recordings or motion-picture recordings of me individually or in a group; (2) use or reuse such photographs, recordings, video recordings, audio recordings, and/or motion pictures in all media throughout the world in perpetuity; and (3) use my name, likeness, and/or physical depiction for any purpose in perpetuity, in an unedited or edited manner or fashion, as the Miss Iconic USA Organization, in its sole discretion, shall determine. This authorization shall also include the use of all such photographs, recordings, video recordings, audio recordings, and/or motion-picture films made during my year of service.

8 Change in Circumstances. I understand that if, at any time between the date of registration and the completion of my year of service, any facts concerning my eligibility to participate in the program should change, including, without limitation, my citizenship, marital or parental status, good character, and reputation, including social media, the Miss Iconic USA Organization shall have the right, in its sole discretion, to determine that I am not eligible to continue to participate or serve as a Miss Iconic USA titleholder. In the event this occurs, the Miss Iconic USA Organization may, at its option, forfeit my title and all prizes, awards, and prerequisites of the position.

9 Sportsmanship and Conduct. Any contestant, family member, or guest showing less than sportsmanlike behavior will lead to the disqualification of the contestant and/or refusal of any future participation with the Miss Iconic USA Organization.

CONTESTANT RELEASE AND INDEMNITY AGREEMENT

I, a contestant in the Miss Iconic USA National Pageant, do hereby knowingly and voluntarily release the Miss Iconic USA National Pageant, the officers, directors, trustees, judges, employees, and any other person, firm, heirs, administrators, executors, successors, and assigns from and against any and all claims, lawsuits, demands, damages, loss of service, actions, and causes of action based upon, arising out of, or in any way related to any honors, rights, or awards sought by me as a contestant in the current year.

Further, I do hereby agree to exonerate, hold harmless, and indemnify Miss Iconic USA from any and all claims that I or my representative may have against Miss Iconic USA, past, present, or future, in connection with such honors, rights, and awards. Such indemnification shall include any and all fees, including reasonable attorneys’ fees, costs, and other expenses reasonably incurred by or on behalf of claims, lawsuits, demands, actions, or causes of action.

To the fullest extent permitted by law, Miss Iconic USA, its officers, directors, employees, representatives, affiliates, sponsors, vendors, and contractors, along with Oaklawn Hot Springs, its owners, employees, representatives, and affiliates, shall not be responsible or liable for any sickness, illness, injury, dismemberment, or death arising from or occurring during any aspect of the pageant. They shall also not be responsible for any personal property that is lost, stolen, or damaged, including, but not limited to, clothing, shoes, gowns, costumes, jewelry, luggage, or other belongings, whether the incident occurs in the event center, elsewhere on the resort property, in a hotel room, in a restaurant, or in any other area of Oaklawn Hot Springs.

All fees and payments pertaining to any portion of the national registration or any Miss Iconic USA event are, under no circumstances, refundable or transferable before, during, or after the pageant. This includes, but is not limited to, national registration fees, optional competition fees, admission tickets, gala tickets, program book purchases, advertisements, merchandise, and any other pageant-related fees or purchases.

ACKNOWLEDGMENT AND ELECTRONIC ACCEPTANCE

I have been given a sufficient opportunity to review this agreement and its terms. I have also had the opportunity to consult with an attorney of my own choosing to receive legal advice concerning this agreement, or I have decided that I do not need to do so.

I understand that this agreement is a legal document and that my electronic acceptance and signature will create legal obligations that are binding upon me. I agree to be bound by this agreement and all of its terms.

If the contestant is under eighteen years of age, the parent or legal guardian electronically accepting and signing this agreement represents that he or she has the legal authority to enter into this agreement on behalf of the contestant.

By checking the acknowledgment box and providing my electronic signature, I acknowledge that I have read, fully understand, and voluntarily agree to the terms of this Miss Iconic USA Contestant Agreement, Release, and Indemnity Agreement.
